Welcome to the Frontwave Foundation’s Silent Auction!

We are excited to offer you the chance to bid on an unforgettable VIP Suite experience for the KSON All American Summer Country Concert at Frontwave Arena. Please review our auction rules to ensure a smooth and fair experience for all participants.

1. Bidding Period

Bidding will begin at 9:00 AM on May 15, 2025, and end at 8:00 PM on June 8, 2025. Eligible entrants will bid on the auction item using the online form provided on the Silent Auction site, located at https://www.zeffy.com/ticketing/kson-concert.

2. Fair Market Value

The auction item is priced based on its fair market value. The VIP Suite Package is valued at $6,000 (including tickets, parking passes, and gift bags).

3. Minimum Bidding Increment

Bids must increase by a minimum increment of $100. Bids not adhering to this increment will be disqualified.

4. Multiple Bids

Participants may place multiple bids on the VIP Suite Package. Each new bid must be higher than the previous bid by at least the minimum increment. The silent auction platform (Zeffy) will email you if you are outbid so you will have a chance to counter bid.

5. Finality of Bids and Sales

All bids and sales are final. No refunds or exchanges will be provided once the auction closes.

6. Payment Obligations

The winning bidder agrees to pay in full by 8:00 PM on June 8, 2025. Payment will be processed automatically at the close of the auction by credit card.

7. Limitations

The VIP Suite Package is limited to the winning bidder only. It includes 16 tickets and 8 VIP parking passes.

8. Age Restriction

Entrants in the Frontwave Foundation Silent Auction must be at least 18 years of age and have valid government-issued identification and tax identification numbers.

9. Assumption of Risk

The winning bidder assumes all risks related to using the VIP Suite, concert attendance, and any associated experiences.

10. Item Changes

The Frontwave Foundation reserves the right to make changes or withdraw the VIP Suite package without prior notice if necessary. We apologize for any inconvenience.

11. Determination of Winners

The highest bid received by 8:00 PM on June 8, 2025, will determine the winner of the VIP Suite Package. Payment will be processed automatically and the winner will be notified.

12. As-Is Condition

The VIP Suite Package is sold as-is, with no guarantees or warranties beyond the details provided. Ticket winners will need to provide a valid email address. An employee of Frontwave will email or call the Silent Auction winner to arrange delivery of the tickets 48-72 hours before the event's scheduled start. Redeeming and using the prize(s) in this Silent Auction requires the winner(s) (i) to have a valid email address and an app-enabled mobile device capable of downloading and running AXS, a third-party mobile ticketing app; (ii) to install, or have already installed, such mobile ticketing app on their app-enabled mobile device; and (iii) to login into an existing user account or to sign up for a free user account with the third-party operating such mobile ticketing app by completing a form with all required information, including at a minimum first name, last name, and valid email address. THE PRIZE(S) IN THIS SILENT AUCTION CANNOT BE REDEEMED OR USED BY ANY MEANS OTHER THAN THE DESIGNATED THIRD-PARTY MOBILE TICKETING APP FOR THIS PRIZE. INDIVIDUALS WHO DO NOT HAVE A VALID EMAIL ADDRESS, ACCESS TO AN APP-ENABLED MOBILE DEVICE AND/OR DO NOT COMPLY WITH THE FOREGOING REQUIREMENTS WILL NOT BE ABLE TO REDEEM OR USE THE PRIZE(S) IN THIS SILENT AUCTION SHOULD THEY BE SELECTED AND VERIFIED AS A WINNER, WILL NOT RECEIVE A SUBSTITUTE PRIZE, AND SHOULD NOT ENTER THIS SILENT AUCTION.

13. Liability / General Rules

The Frontwave Foundation is not responsible for any loss that may occur in connection with the Silent Auction. Entrants agree to hold Frontwave harmless from any liability arising from participation in the Silent Auction or the prize's acceptance, receipt, possession, or misuse. Frontwave and each of its officers, directors, employees, members, representatives and agents are not responsible for any negligence, claims, liability, injury, property loss, or other damages of entrants and/or winners arising from or in connection with, acceptance, receipt, possession, or use/misuse of prizes awarded or participation in the Silent Auction. Prize cannot be substituted, assigned or transferred by winners.

14. Disputes / Arbitration

Except where prohibited by law, as a condition of participating in this Silent Auction, the entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Silent Auction or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively, by final and binding arbitration under the rules of the American Arbitration Association (“AAA”) and shall be held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement, and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will the entrant be permitted to obtain awards for, and the entrant hereby waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, including attorney’s fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Silent Auction), and entrant further waives all rights to have damages multiplied or increased.

15. Taxes

Taxes on the prize, if any, are the sole responsibility of the winner, who is advised to seek independent counsel regarding the tax implications of accepting a prize.
